Welcome to the web site (“Site”) for Kaplan Myanmar, part of Kaplan, Inc., a subsidiary of Graham Holdings Company (“Kaplan”), and the parent company of Kaplan Test Prep and Admissions, Kaplan Higher Education, Kaplan Professional and Score! (collectively, “Kaplan Businesses”). This User Agreement, including our Privacy Policy, governs your use of the Kaplan Site.

Please read this User Agreement carefully, because by visiting or using the Kaplan Site, you agree to follow its rules. From time to time we may modify these rules. We will notify you of any significant change by posting a notice on our home page and information collection forms. Your continued use of the Kaplan Site after any modification indicates your agreement to the new terms.

Privacy Policy

Please review our Privacy Policy, which is a part of this User Agreement and describes how Kaplan handles any personally identifying information collected from visitors to this Kaplan Site.

Web Site Materials. Copyright on the Kaplan Site and all materials included in it is owned by or licensed to Kaplan and all rights are reserved. You must abide by all copyright notices and restrictions contained on the Kaplan Site. You may not copy, distribute, enter into a database, display, perform, create derivative works of, transmit, or otherwise use any materials from the Kaplan Site (including computer programs or other code) (“Site Materials”), except that you make a reasonable number of machine-readable copies of the Site Materials only for personal, non-commercial use, and only if you do not alter the text or remove any trademark, copyright, or other notice displayed on the Site Materials.

Trademarks

KAPLAN, KAPLAN TEST PREP AND ADMISSIONS, KTPA, SCORE!, KAPLAN PROFESSIONAL, KAPLAN HIGHER EDUCATION, the Kaplan Logo, the KHEC logo, the KTPA logo, and any other trademarks on the Kaplan Site are trademarks owned by Kaplan, Inc. (“Kaplan Trademarks”). You may not use the Kaplan Trademarks in connection with any product or service that does not belong to us, or in any manner that is likely to cause confusion among users about whether we are the source, sponsor, or endorser of the product or service, or in any manner that disparages or discredits us.

Links, Frames, and Metatags

You may link to the home page of the Kaplan Site as long as the link does not cast us in a false or misleading light. You may not frame the content of the Kaplan Site. You may not use metatags or any other “hidden text” that incorporates the Kaplan Trademarks or our name without our express written consent.

Links to Other Web Sites

The Kaplan Site contains links to the Web sites maintained by each of the Kaplan Businesses and their subsidiaries. Please note that each of the Kaplan Business Web sites are governed by its own user agreement and privacy policy, which may be different in some respects from the User Agreement and Privacy Policy governing this Kaplan Site. If you visit a Web site belonging to one of the Kaplan Businesses, be sure to read that Kaplan Business’s user agreement and privacy policy so that you understand the rules that govern your use of that particular Web site.

Disclaimer and Limitation of Liability

Governing Law

This User Agreement will be governed by the laws of Singapore applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts sitting in Singapore and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Termination

We reserve the right to suspend the Kaplan Site or terminate this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.

Collection and Use of Personal Data

Collection of Personally Identifying Information. We do not directly collect any personally-identifying information through the Kaplan Site save with your consent. However, we do offer links to the Web sites of the various Kaplan Businesses, through which you may provide personal data. In addition, we provide a Web page that allows you to apply for a position with one of the Kaplan Businesses. In applying for employment, you may be asked to submit your name, postal address, phone number, email address, educational background, work background, and any additional information that you voluntarily decide to provide (“Application Data”). Your Application Data is collected and processed by the Kaplan Business to which you applied. The Kaplan Business then uses your Application Data to evaluate your eligibility for open positions and to contact you regarding your application.
Sharing with Third Parties. Some of the Kaplan Businesses may use service providers who to process the Application Data. These service providers are restricted from using your personal data in any way other than for the service they are providing. There may also be occasion for the Kaplan Business to disclose your personal data to third parties if it believes, in its sole discretion, that such disclosure is required by law, to enforce its user agreement or privacy policy, or in connection with a sale or transfer of some or all of the assets in the Kaplan Business.
Security. Kaplan is concerned with the security of your personal data. Each of the Kaplan Businesses has put in place measures to keep your personal data secure. To learn more about these security measures, please check the privacy policy posted on the Web site for the Kaplan Business to which you have submitted your data.

Anonymous Information

We collect anonymous data when you visit most pages on the Kaplan Site. Your visit may automatically provide us with data that is not linked to your personal information, such as your IP (Internet Protocol) address, browser type, operating system, domain name, access times, and referring web site addresses. Some parts of the Kaplan Site use embedded pixel technologies to facilitate your use of the Web site and to track general traffic.
